Three policies, three jobs
| Policy | What it can do for a pool | Watch for |
|---|---|---|
| Homeowners (private insurer) | Liability for injuries; the pool as part of the home or as a separate structure | Low or no pool liability; diving boards and slides; separate-structure limits |
| TWIA windstorm (Jefferson County) | Wind and hail damage; pools and fences are listed as insurable items | Other structures capped at 10% of dwelling cover; screen cages excluded unless listed |
| NFIP flood | The house and, if bought, its contents | Pools, fences, decks, patios and landscaping are not covered |

Flood water and the pool
Harvey flooded more than 64,000 homes across the area (NWS), and the pool in a flooded yard is on its own. FloodSmart lists landscaping, septic systems, decks and patios, fences and swimming pools as property outside an insured building that flood policies do not pay for (FloodSmart). The list does not mention pool equipment, so ask your agent how a pump and heater on an outdoor pad are treated.
The cheaper protection is design: an equipment pad raised above the yard, deck drains and an overflow line, all covered on our hurricanes and flooding page. Check your lot on the FEMA map before you settle the pad height.
Wind: TWIA and the 10% limit
Jefferson County is one of the 14 first-tier coastal counties where TWIA writes windstorm cover, and its eligibility page names signs, fences, swimming pools and flagpoles as miscellaneous items (TWIA). Orange and Hardin counties sit outside that first tier (TDI), so homes there buy wind cover from their regular insurer.
Read the limits. TWIA's dwelling policy caps other structures at 10% of the dwelling limit, and that includes structures joined to the house only by a fence. Metal screen enclosures are not covered unless they are described on the declarations page (TWIA policy). On a house insured for $250,000, that is $25,000 for every detached structure together (our arithmetic). A cage also needs its own WPI-8 certificate (TWIA).
Liability: the gap most owners miss
TDI's advice for pool owners is blunt: many homeowners policies carry minimal or no liability coverage for pools, and an insurer may not cover liability at all for a pool with a diving board or slide. Many insurers, like city codes, require a fence and locking gate, and some will not renew a policy on a poorly kept pool (TDI). TDI also suggests adding the value of new decks and landscaping to your policy, and making sure the pool itself is counted in the home's replacement value.
The fence your city requires (see permits and fences) usually satisfies the insurer too, but ask. TDI's consumer help line is 800-252-3439.
Calls to make before the dig
- Your homeowners agent: pool liability limit, diving board or slide rules, and whether the pool counts as part of the house or a separate structure.
- TWIA or your wind insurer: the other-structures limit, and the paperwork for any screen enclosure.
- Your flood agent: how outdoor equipment is treated.
- Your builder: proof of their own liability insurance while the hole is open.
Common questions
Does flood insurance cover a swimming pool?
No. FEMA's FloodSmart lists fences and swimming pools, along with decks, patios and landscaping, as property outside the building that flood policies do not cover (FloodSmart).
Will my homeowners insurance cover pool injuries?
Maybe not enough. TDI says many homeowners policies provide minimal or no liability coverage for pools, and diving boards or slides can rule it out (TDI). Ask your agent for the exact limit before the pool is built.
Does TWIA cover my pool in Jefferson County?
TWIA lists swimming pools and fences as insurable items (TWIA), but its dwelling policy limits other structures to 10% of the dwelling cover and excludes screen enclosures unless declared (TWIA policy).
